The Wednesday call that changed how a Knightsbridge landlord managed his portfolio.

He called us about an expired EICR certificate on a Sloane Avenue flat that expired in January, new tenancy starting Saturday, three companies had told him two to three weeks. We said Thursday. Certificate issued Thursday. Tenants in on Saturday. On the Monday he called again.

Portable Appliance Testing PAT testing is the safety inspection of portable electrical appliances. Every electrical appliance that is not permanently fixed to the building is portable: televisions, washing machines, dishwashers, microwaves, kettles, toasters, lamps, computers, extension leads, and all other electrical equipment that connects to a socket rather than being wired directly into the building.

PAT testing checks two things for each appliance: the earth continuity, whether the earth connection is intact and the appliance is properly protected and the insulation resistance, whether the insulation around the electrical conductors is intact and preventing leakage of electrical current. A pass means both checks are within the required limits. A fail means the appliance has a fault that makes it unsafe to use and must be repaired or replaced before being returned to service.

The PAT test certificate lists every appliance tested, the result for each, and the date of the test. It is the documented evidence that the appliances in a property have been professionally assessed and were safe at the time of testing.

PAT testing is not a statutory legal requirement in the same way that EICR certificates and Gas Safety Inspections are. There is no specific legislation that mandates PAT testing for residential landlords in England.

However, the Electricity at Work Regulations 1989 and the Health and Safety at Work Act 1974 both impose a general duty of care on anyone responsible for electrical equipment used by others. For a landlord providing electrical appliances to tenants and for a business providing electrical equipment to employees or visitors, that duty of care requires that the equipment is maintained in a safe condition. PAT testing is the accepted method of demonstrating compliance with that duty.

Without a PAT test certificate, a landlord cannot demonstrate that they discharged their duty of care. In the event of an electrical incident involving a faulty appliance, the absence of PAT testing records is a significant liability.

The most immediate practical requirement for Chelsea landlords is not the legal duty of care but the insurance requirement.

The majority of specialist landlord insurance policies that cover furnished rental properties for the specific risks of letting require annual PAT testing as a condition of cover. This means that a furnished Chelsea rental property without a current PAT test certificate may not be covered by the landlord’s insurance in the event of an electrical fault caused by a faulty appliance.

The landlord whose microwave and floor lamp we found to be faulty during the PAT test, both showing insulation resistance faults, would have had a very different conversation with his insurer if either appliance had caused a fire or injury and no PAT test certificate was in place. The certificate is not primarily about proving the appliances are safe. It is about proving that a qualified, NICEIC-approved engineer checked them and identified any that were not.

PAT testing frequency guidelines are not fixed by specific legislation; the Electricity at Work Regulations 1989 require equipment to be maintained in a safe condition but do not specify testing intervals. The appropriate frequency depends on the type of equipment and the environment in which it is used.

For furnished rental properties across Chelsea, Knightsbridge, and Belgravia, the standard and widely accepted recommendation is annual PAT testing. This is the frequency required by most specialist landlord insurance policies and by most letting agents as a standard condition of property management.

For commercial premises, offices, retail, and serviced accommodation, the frequency may be higher depending on the nature of the equipment and the level of use.

The certificate lists every appliance tested, the result for each pass or fail, the date of testing, the name and NICEIC number of the engineer who carried out the test, and the recommended date of the next test.

A failed appliance appears on the certificate with the nature of the fault. The appliance must be repaired or replaced before being returned to service. We advise on the appropriate action for each failed appliance at the time of testing.
